1) Agreement

By accessing or using our website and services (“Services”), you agree to these Terms. If you don’t agree, do not use the Services.

2) Eligibility & Accounts

Our Services are intended for clients who are at least 18 years old. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian, who must be the party to any formal contracts or agreements.

Our collection and use of personal data are described in our Privacy Policy, which is incorporated into these Terms.

3) Orders, Payments & Subscriptions

• Prices may change; taxes/fees may apply.
• Recurring plans renew until canceled; cancel before the renewal to avoid charges.
• Third-party processors handle payments; we don’t store full card details.
• Late/non-payment may pause or terminate Services.

4) Client Responsibilities

• Provide timely content, approvals, and access.
• Ensure you own or have rights to materials you supply.
• Use the Services lawfully and avoid abusive or illegal content.

5) Intellectual Property

We (or our licensors) own the platform, code, and brand assets. You retain ownership of your content. Upon full payment for project work, you receive a license or ownership as specified in your proposal or SOW.

6) License to Your Content

You grant us a non-exclusive license to host, process, and display your content solely to provide the Services.

7) Third-Party Services

We may integrate third-party services such as hosting (Hetzner), analytics (Google Analytics), and payments (Stripe). Their terms and privacy policies apply to their services, and by using our Services you also agree to comply with those terms where applicable.

8) Warranties & Disclaimers

We strive to deliver professional, high-quality websites and hosting services. However, all Services are provided “as is” and “as available.” We do not guarantee that websites will be error-free, uninterrupted, achieve specific business results, or remain compatible with every third-party tool or platform. To the fullest extent allowed by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of Liability

We won’t be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount you paid to us in the 3 months before the event giving rise to the claim.

10) Indemnification

You agree to defend and hold us harmless from claims arising from your content, use of the Services, or violations of these Terms.

11) Suspension & Termination

We may suspend or terminate for any breach or risk to the Services. You may stop using the Services at any time; subscription cancellations take effect at period end.

12) Changes

We may update these Terms. Continued use after changes means you accept the updated Terms.

13) Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules.

Any disputes arising under these Terms will be resolved exclusively in the state or federal courts located in Wyoming, USA, and you consent to the jurisdiction of those courts.
